Terms of Service
Last updated: 14 October 2026
These terms are an agreement between you and MATHINKCO LLC, a Delaware limited liability company ("Brainega", "we", "us"), the company that runs Brainega.com. By creating an account, taking a test, or using the service in any way, you agree to them. If you do not agree, please do not use Brainega.
1. What Brainega is
Brainega is an online service for creating, giving, and marking tests. Test makers create tests and invite test takers. Test takers answer them. The service can also watch for signs of rule-breaking during a test (see "Proctoring" below).
2. Accounts
- A test maker signs in with an email and a one-time code. An organisation has one administrator who can see and manage the tests and test takers of that organisation.
- A test taker signs in with the email address a test maker added or invited.
- You must give true information and keep your email account secure. You are responsible for what happens under your login.
3. Test makers: your responsibilities
You decide who takes your tests, and you are responsible for the questions, the marking, and the decisions you make from the results.
- You must have the right to give us the names and email addresses of the test takers you add.
- Before a test, you must tell test takers (and, for children, their parents or guardians) that the test is proctored, and you must have any permission the law requires where you are. Brainega asks each test taker to agree on screen, but that does not replace your own duty.
- Proctoring flags are only signals. Nothing is penalised automatically. You review the information and make the final decision yourself, and you decide how to use the proctoring information, including whether to rely on it at all. Brainega never blocks, stops or ends a test on its own because of proctoring.
4. Proctoring
When a test is proctored, with the test taker's agreement, Brainega may take photos from the webcam at random times, measure the loudness of the microphone (it does not record or keep audio), and note when the test taker leaves fullscreen or switches to another tab. Photos are shown only to the test maker and the administrator of their organization. Brainega staff do not view them. Photos are deleted after 30 days. Details are in our Privacy Policy.
5. Acceptable use
You must not:
- use Brainega for anything illegal, or to harass, harm, or discriminate against anyone;
- try to break, overload, or get around the security of the service, or access data that is not yours;
- share answers to a live test, or help anyone cheat;
- upload content that you do not have the right to use, or that is harmful or infringes someone else's rights;
- resell or copy the service without our written permission.
We may suspend an account that breaks these rules.
6. Your content
You keep ownership of the questions, answers, and other content you put into Brainega. You give us permission to store, process, and show that content as needed to run the service for you. We do not sell your content or use it for advertising.
7. Plans, payment, and renewal
- Brainega has a free plan and paid plans. Every plan includes unlimited tests. Plans differ in the number of test takers an organization can have. The current limits and prices, in US dollars (USD), are shown in the Pricing section of our home page. The price shown to you at checkout is the amount you pay.
- Plans are bought by the administrator of an organization, and cover everyone in it. Test takers never pay and are never asked for payment details.
- Payments are processed by our payment provider, Stripe. We do not see or store your card or bank details. Brainega is available worldwide. Prices are charged in USD, and your bank or card issuer may add its own currency conversion or foreign transaction fees.
- Prices do not include taxes. Where tax applies, it is calculated by Stripe and shown at checkout before you pay. If your organization is exempt from tax, you can declare this at checkout, and you are responsible for that declaration being correct.
- Promotional codes may be entered at checkout. Codes are issued at our discretion, may have conditions or an end date, and have no cash value.
- Automatic renewal. Paid plans are subscriptions, billed monthly or yearly as you choose. A subscription renews automatically at the end of each period, at the price then in effect, and is charged to the same payment method, until you cancel. You can cancel at any time before the renewal date from Manage billing on your plan page.
- Cancelling. If you cancel, the subscription will not renew, and your plan stays active until the end of the period you have already paid for.
- Upgrading. You can move to a bigger plan at any time and it starts straight away. You are charged the difference for the rest of the current billing period, with a credit for the unused time on your old plan, as calculated by Stripe.
- Downgrading. A move to a smaller plan takes effect at the end of the current paid period.
- We may change our prices. A price change never affects a period you have already paid for, and we will tell you before a subscription renews at a new price.
- The number of test takers counted is the number of different people added to the tests of your organization. See our Refund Policy for refunds.
8. When a paid plan ends
If a renewal payment fails, Stripe tries again and emails you. If it is still not paid 7 days after the renewal date, the paid plan ends. When a paid plan ends, for this or any other reason, your tests, questions, and results stay in your account and nothing is deleted. The test taker limit returns to that of the free plan. You can still add test takers up to that limit. If you have more test takers than the limit allows (for example, students who have left), your administrator can delete test takers to come back within the limit, or you can choose a plan again at any time.
9. Availability and changes
We work to keep Brainega available, but we do not promise that it will never be interrupted or free of errors. Do not rely on the service for anything where a short outage would cause serious harm without a back-up plan. We may improve or change features. If we make a change that matters to you, we will try to tell you.
10. Ending your account
You can stop using Brainega at any time. We may suspend or end an account that breaks these terms. Please download any results or photos you need to keep (the download button on each test page) before you leave, because proctoring photos are deleted after 30 days.
11. Disclaimers and limits
Brainega is provided "as is". To the extent the law allows, we are not liable for indirect or consequential loss, for loss of data, or for decisions made from test results or proctoring flags. To the extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits a right or liability that cannot be limited by law.
12. Governing law and disputes
These terms (including section 13 on data processing), and any dispute or claim arising out of or relating to them or to your use of Brainega, are governed exclusively by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. The state and federal courts located in the State of Delaware have exclusive jurisdiction, and you agree to submit to them. This applies wherever you are located, to the fullest extent the law allows.
13. Data processing for organizations
This section applies to every organization that uses Brainega, such as a school, college, company or competition (the "Organization"). It explains how we handle the personal information of the Organization's test makers and test takers. It applies automatically. No signature is needed.
13.1 Roles
The Organization decides why and how the personal information of its test makers and test takers is used (it is the controller). Brainega handles that information only on the Organization's behalf and on its instructions (Brainega is the processor), to provide the service described in the Terms. Where the Organization is a school, Brainega acts under the school's direct control for the purpose of providing the service.
13.2 What information, and why
- Test makers: name, email address, and (if given) phone number and mailing address.
- Test takers: email address, and if the Organization adds them, name, grade and section; test activity, answers and results; and, for proctored tests, webcam photos, microphone loudness numbers (no audio is recorded) and notes about leaving fullscreen or switching tabs.
This information is used only to deliver, mark and report the Organization's tests, to secure the service, and to send the emails the service needs (sign-in codes and invitations).
13.3 Our commitments
- We process the information only to provide Brainega to the Organization, and never for advertising or profiling.
- We do not sell the information, and we do not share it with anyone except the sub-processors listed below, or where the law requires it.
- People who work on Brainega are bound by confidentiality, and get access only when they need it to run or support the service. Brainega staff do not view proctoring photos, test answers or results.
- We use encrypted connections (HTTPS) and access rules so that each Organization sees only its own information.
- If we become aware of a breach of security affecting the Organization's information, we will tell the Organization without undue delay and help it meet its own obligations.
- We will help the Organization answer requests from its test makers, test takers, or their parents or guardians, to see, correct or delete their information.
13.4 Sub-processors
Brainega uses these service providers to run the service. Each processes information only to provide its service to us:
- Supabase: database, sign-in and file storage
- Netlify: website hosting
- Resend: email delivery of sign-in codes and invitations
- Stripe: payments (only for administrators who buy a plan; never for test takers)
If we add or replace a sub-processor, we will update this list. Some sub-processors may store information outside the Organization's country.
13.5 Keeping and deleting information
- Proctoring photos are deleted automatically 30 days after they are taken.
- The Organization's administrator can delete test takers at any time, which also deletes their attempts, answers and proctoring information for that Organization.
- When the Organization asks us to close its account, we delete or return its information within a reasonable time, unless the law requires us to keep it.
13.6 Children and consent
Where test takers are children, the Organization is responsible for informing parents or guardians and for obtaining any consent the law requires, including consent to proctoring, before the test. The Organization decides how proctoring is used.
14. Changes to these terms
We may update these terms. The date at the top shows the latest version. If you keep using Brainega after a change, you accept the new terms.
